Acton woman wins discrimination claim

A MUSLIM woman from Acton was awarded £4,000 yesterday for "injury to feelings" after a hair salon owner refused to employ her because she wears a headscarf.

Bushra Noah accused Sarah Desrosiers, owner of a trendy Kings Cross hair salon, of religious discrimination after she failed to offer her a job in May last year.

A panel sitting at the central London employment tribunal dismissed her claim of direct discrimination but upheld her complaint of indirect discrimination.

Giving its judgment, the tribunal said it accepted that Ms Desrosiers said that Mrs Noah lived too far away but was persuaded to give her an interview.

But when the 19-year-old applicant arrived at the salon she claimed that the Canadian salon owner was clearly shocked by the fact she wore a headscarf.

Ms Desrosiers told the tribunal she was surprised that the younger woman had not mentioned it earlier.

She said she needed stylists to reflect the "funky, urban" image of her salon and showcase alternative hairstyles.

If an applicant had a conventional hairstyle she would insist that it was re-styled in a more "alternative" way, she said.

After a 15-minute meeting she and Mrs Noah parted and both parties told the tribunal it was obvious that the 19-year-old would not be offered the job.

The panel refused an application by Mrs Noah for aggravated damages and rejected her claims that the episode had put her off hairdressing, finding that she applied for further salon jobs before deciding to retrain in tourism.

But they did find that she had been badly upset by the interview and awarded Mrs Noah £4,000 damages for "injury to feelings''.

In their judgment, the panel stated they were satisfied the salon owner did not discriminate against Mrs Noah, but said the "degree of risk" from Mrs Noah working in the salon with a covered head was not as great as Mrs Desrosiers believed.

Ms Desrosiers, 32, said: "I feel it is a bit steep for what actually happened. It's really scary for a small business.

"I never in a million years dreamt that somebody would be completely against the display of hair and be in this industry. I don't feel I deserve it.'' Mrs Noah's legal representatives were not available for comment.

What an absolute nonsense. If it is conditional, as you would expect, for you to show your hair in a hair stylists than what the hell was this pathetic individual doing applying knowing that she could not (would not due to some poor interpretation of Islam) show her hair.

I'm 6'5" tall. I am now going to apply for a job as one of Snow White's dwarves as I could do with the £4000 when I am rejected for the job.

Well done the tribunal, done over good and proper by a 19 year old 'chancer'.

Hmm. I'm tempted to go an apply for jobs as a model, then claim my £4,000 when I get told I'm too ugly. Dave is right - this girl's a chancer.

A trendy hair salon is entitled to refuse to employ someone who covers her hair, as it's true that many people only want their hair cut by someone with great hair. As an example, loads of women in my office are sporting the "Natasha", cut by a girl down the road.

For the love of Pete, what is going on here? Four grand for being rejected at a job interview? How about the injury to my feelings caused by idiots who go around blowing themselves up on trains? Not to mention the annual devastation I feel when Arsenal throw the title away over the Christmas holidays.

No doubt we'll be seeing a long line of convicted criminals in the Hendon area before too long, all waiting their turn to get rejected by the Met so they can get their largesse.

Absolute codswallop. I want to be an Imam at the local mosque, where do I apply and can anyone recommend a good solicitor?

What part of wearing a headscarf is part of the British culture? It is not.

Do you think a Muslim country would let you sue for discrimination on Christian grounds? Hello no!

I often see advertisements in the local press encouraging people to become foster parents. They seem to be desperate for people from all walks of life to help out. It made me realise I might have something to contribute but because I cannot afford to live in anything but a one-bedroom flat it is out of the question. I accept that this is sensible, nonetheless my feelings are hurt that I am being discriminated against because I only have one bedroom. Some money would make me feel slightly better and might help me to get a bigger place.

Recently I've thought it must be nice to be a vicar and that it would be the ideal job. Now I realise that having no faith shouldn't be an obstacle for applying for the job.

Hopefully the salon owner's got £4,000 plus costs free advertising from this sorry saga.

Actually, if Australians ever needed more evidence that Muslims should be banned from entering their country, it is this nonsense.

This isn't jihad or terrorism. This is insidious erosion of local cultural values.

Canadians are part of the Commonwealth, and celebrate the British Queen as their own.

And along comes someone from a culture completely incompatible from the West's, and instead of graciously accepting she wasn't the right candidate for the job, she abuses the poor Canadian woman. AND THE BRITISH JUSTICE SYSTEM PERMITS THE MUSLIM HER PERVERSE AND SICK FAILURE TO ACCEPT SHE WASN'T RIGHT FOR THE JOB.

Will you stand by and watch? What do you think Canadians will take away from this? Do Muslims really want people to think they have hate in their hearts in every part of daily life? Since when did you feel you could sue a company for your failure to behave as the company expected? And on incompatible cultural grounds?

Is this a joke? This girl is pathetic and the panel who awarded her money need sacking! I feel so sorry for future employers for this idiot. And the government are to blame for bringing in the rubbish Human Rights law, which spoils the lives of decent human beings and helps the nasty!

I can't understand what this country has come to. Young men who sign up as soldiers who commit to risking their lives i defence of us all are given scant resources while immigrants intent on blasting apart our values and cultural identity are perversely rewarded. Seems like our politicians and judges are compeletely out of touch with the way people feel about this whole issue!

jason - you're the one playing the race card. nothing racist or facist about defending the traditional cultural identity, customs, religion and values of the Britain that many of us know and cherish. British people have been very tolerant and liberal towards different races of immigrants but this is just a ridiculous step too far! We have a right to resist the changes that some immigrant groups would inflict on us. Why shoud we always back down and accommodate new people who want to change our way of life. It is very unsettling and it is an intolerable liberty.

In his zeal to brand us all fascists, Jason misses a crucial point: nobody invited the woman here, nobody was asked if they wanted the woman here and it would appear that a fair few people would like to see the back of her. All we're asking for is some democracy. The dictatorial tendencies lie with those who demand that the rights of the few usurp the rights of the many.

Dead right, that is exactly where the fault lies.

Reminds me of a city woman who recently resigned from her £120K job because she had been reduced to a complete nervous wreck and was awarded about £6 million compensation because she would not be able to work again.

Afterwards, we learn that she prompted moved another job paying £150K.
She was not an immigrant.
Any flattering comment about her?
